1. Eligibility: This Prize Promotions Scratch Off (”Promotion”) is offered and open only to legal residents of the continental United States (except residents of New York) and may be conducted throughout the United States (except for New York) in accordance with applicable laws. This Promotion is not a contest, sweepstakes, lottery or raffle. All recipients of a scratch card will be entitled to receive one of the listed prizes. Employees of Sponsor, any Promoter, or any other party involved in any aspect of this Promotion, and their immediate family members are not eligible to receive any prize. In the event a Promoter imposes additional eligibility requirements, which it may in its sole discretion, then Sponsor shall have no responsibility or liability relating to said additional eligibility requirements.

2. To Enter: Visit the business establishment of any Promoter to receive a scratch card. Any individual who receives a scratch card from a Promoter is automatically entered in the Promotion for a chance to win a prize. Only 50,000 scratch cards will be available, and all scratch cards contain a prize. Simply scratch off the box in the upper right-hand corner to reveal the prize you are eligible to win. NO PURCHASE NECESSARY TO ENTER OR WIN. PRODUCT PURCHASE WILL NOT ENHANCE CHANCES OF WINNING A PRIZE. VOID WHERE PROHIBITED BY LAW.

3. Promotional Period: This Promotion starts on May 25, 2006, and ends when all 50,000 scratch cards have been distributed, which may or may not occur by December 31, 2007. Visit http://www.prizepromotionsrules.com regularly to see when the Promotion has officially ended. All prizes must be claimed within thirty (30) days of the end date shown on http://www.prizepromotionsrules.com. To claim your prize, contact the Promoter where you obtained the scratch card for instructions or contact the Sponsor at the address listed below. Once the Sponsor receives notice of a prize claim, Sponsor will verify the scratch card’s authenticity. Within thirty (30) days of authentication of the scratch card, Sponsor will send the prize recipients an affidavit of eligibility and liability/publicity release. Sponsor will deliver all prizes within 10 to 12 weeks of receiving the signed affidavit and release. All redeemed scratch cards become the property of Sponsor and will not be returned.

4. Prizes: All recipients of a scratch card are eligible to win a prize. The prizes consist of:

• one (1) brand new Dodge Viper with an approximate retail value of $80,000 or a $80,000 cash prize (this prize recipient must choose either the Dodge Viper or the cash);
• two (2) 10-night Hawaiian vacations with two (2) roundtrip coach class airline tickets with an approximate retail value of $3,700;
• five (5) cash prizes of $2,500;
• forty-nine thousand nine hundred fifty seven (49,957) 9-day California Adventure trips with an approximate retail value between $330 and $2,022; and
• thirty five (35) Sony 32-inch Flat Screen Digital Televisions with an approximate retail value of $650.

In the event there are more prize claims than prizes due to printing or human error, the prize recipients will be determined by random drawing from among all eligible claims. No substitution, transfer, or assignment of prize permitted, except that Sponsor reserves the right to substitute a prize of equivalent value in the event the offered prize is unavailable. All prizes are expressed in U.S. Dollars. In the event a prize recipient is deemed ineligible or if a prize recipient fails to claim the prize by the deadline, the prize will not be awarded to any other person. ALL TAXES ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE PRIZE RECIPIENTS. Any prizes won by a minor (as minor is defined by the jurisdiction of the minor’s residence) will be awarded in the name of, or to, the minor’s parent or legal guardian, or as may otherwise be deemed appropriate by the Sponsor, in its sole judgment. The parent or guardian of the minor must execute all documents and agrees to all obligations and undertakings on behalf of himself/herself and the minor, or the prize may be forfeited.

5. Odds: The odds of winning a prize are the following:

• Dodge Viper or $80,000 cash – 1 out of 50,000;
• 10-night Hawaiian vacation with two (2) roundtrip coach class airline tickets – 2 out of 50,000;
• $2,500 cash – 5 out of 50,000;
• 9-day California Adventure trips – 49,957 out of 50,000; and
• Sony 32-inch Flat Screen Digital Televisions 35 out of 50,000.

6. Terms and Restrictions: The prize recipient of the car must take delivery from a dealership designated by Sponsor. The car only comes with standard features. Any optional features and/or equipment will be the sole responsibility of the prize recipient. In addition, the prize recipient of the car is liable for all taxes, title, license, registration dealer preparation, insurance, and other taxes and fees associated with the receipt, use and/or ownership of the car. The prize recipients of the California Adventure trips are responsible for all meals, excursions, drinks, room taxes of $3 to $17 per night, and any other charges, costs or fees that are not expressly guaranteed as part of the prize package. Other than the two (2) round-trip coach class airline tickets awarded to the prize recipients of the Hawaiian vacation, no other transportation is provided to any prize recipient.

7. Additional California Adventure Terms and Restrictions: Prize recipients of the California Adventure trips must comply with certain requirements in order to be eligible to receive this prize.

• This California Adventure Certificate entitles the recipient to three 3-day/2-night vacations to one of the following destinations: Avila Beach, Anaheim, Palm Springs, San Francisco, Cabo San Lucas or San Diego, subject to availability and certain restrictions.
• Accommodations are for two adults 18 years of age or older and up to two children under 18.
• Due to the nature of this program, locations may be added and deleted at any time.
• No pets allowed.
• This certificate is for promotional use only and is non-transferable, cannot be sold to the end user without expressed written consent, and cannot be redeemed for cash.
• The issue date must be filled in by the Sponsor. You must activate your certificate within 60 days of the issue date. All requests must include a $50 refundable deposit (except for CA residents).
• You have one year from the activation date to complete travel.
• Reservation requests may be made at the same time as, or after, activation. Please indicate two choices of dates and destinations in order of preference.
• All reservation requests require 30 days advance notice and are subject to availability.
• The three 3-day/2-night vacations can not be used together or consecutively, they must be used a minimum of 30 days apart from each other.
• Holidays or date requests given under 30 days advance notice are $25 extra per night per person.
• A Reservation Confirmation Letter will be mailed to you within 72 hours of your request being confirmed.
• YOUR CHECK-IN VOUCHER AND IDENTIFICATION WILL BE REQUIRED UPON CHECK-IN.
• This Certificate is for hotel accommodations only and does not include transportation, airfare, room taxes ($3-$17 per night), meals and any other miscellaneous expenses.
• Upon check-in, hotels will require an imprint of a major credit card to cover such costs.
• Written notice of cancellation or changes to an active reservation must be received at least 8 days prior to your arrival date.
• Failure to cancel or reschedule at least 8 days prior to arrival or simply not showing will result in forfeiture of your certificate and deposit.
• Any changes or cancellations in reservations must be in writing and will be assessed a fee.
• This certificate cannot be used at the same time as a friend or family member traveling to the same destination.
• Your $50 deposit will be refunded 30 days after travel or if we cannot confirm your reservation request.
• If your reservation has been confirmed, there is no refund until after you travel.
• Refund requests must be made in writing. If paid by credit card, your card account will be credited. If paid by check, your deposit will be mailed to you.
• Valid arrival days are Sun., Mon., Tues., Wed. and Thurs. only. Weekend arrivals are available for an additional fee.

8. General Conditions: Prize recipients agree to abide by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Promotion. This Promotion is governed by the laws of the United States (except New York). All federal, state, and local laws and regulations apply. The prize recipients will be required to execute an affidavit of eligibility and liability/publicity release within fourteen (14) days following the date of notification of the Sponsor’s verification of the scratch card’s authenticity. Failure to timely return any documents, or if prize is returned as non-deliverable, or if prize recipient is found not to be in compliance with these Official Rules or otherwise ineligible, may result in disqualification. At no time will any prize recipient be required to provide any payment or consideration to claim any award in this Promotion. By accepting a prize, the prize recipients hereby give permission to Sponsor and/or Promoter and their designees to use, reproduce, exhibit, display, print, distribute, publish and broadcast, without any obligation to compensate, their name, city/state, picture, portrait, likeness, voice, biography, or any statement, contained in, or relating to, their entry in the Promotion in any and all advertising, marketing, and promotional materials, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, except where prohibited by law, and without notice, approval or review by the prize recipients. Where permitted by law, by entering, participants release and hold harmless Sponsor, its respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability or any injuries, loss, or damage of any kind arising from or in connection with this Promotion or any prize won. Any and all intellectual property including, but not limited to, trademarks, service marks, brand names, and logos used in connection with this Promotion is the property of the owners of the prizes given away or licensed to the owners of the prizes given away.

9. Limitations of Liability: Sponsor assumes no liability or responsibility in connection with the safety or performance of any prize distributed hereunder or in connection with any warranty or representation thereto. Sponsor’s sole responsibility is to provide the delivery and fulfillment of all prizes to be awarded in this Promotion. Sponsor is not responsible for late, lost, stolen, damaged, incomplete, or defective scratch cards. Sponsor reserves the right to cancel or modify the Promotion if fraud or technical failures compromise the security, fairness, integrity or proper conduct of the Promotion as determined by Sponsor in its sole discretion.

IN NO EVENT WILL SPONSOR OR ITS PARENTS, DISTRIBUTORS, AFFILIATES, SUBSIDIARIES, OFFICERS, VENDORS, ADVERTISING AGENCIES AND PROMOTION AGENCIES AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THIS PROMOTION. WITHOUT LIMITING THE FOREGOING, EVERYTHING IN THIS PROMOTION IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

10. Arbitration and Disputes: As a condition of participating in this Promotion, you (and your parents/legal guardians if you are a minor) agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Promotion, or any prizes awarded, or the determination of the prize recipients shall be resolved individually, without resort to any form of class action, exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental or consequential damages, or any other damages, including attorney’s fees, other than your actual out-of-pocket expenses (i.e., costs associated with entering this Promotion), and you further waive all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or your rights and obligations of Sponsor’s rights and obligations in connection with this Promotion, shall be governed exclusively by, and construed exclusively in accordance with, the laws of the State of Florida, U.S.A., without giving effect to the conflict of laws rules thereof, and all proceedings shall take place exclusively in that State in the City of Deltona, County of Volusia.

12. Promoters: Any person or business who distributes this or any other scratch card in this Promotion. If permitted by law, a Promoter may require participation at a sales presentation or other promotional activity to receive a scratch card for the purpose of inducing the recipient to undertake a monetary obligation in respect to such Promoter’s goods or services. Each Promoter shall be required to provide its scratch card recipients with any additional disclosures required by law, and Sponsor shall have no responsibility or liability for said additional disclosures.

13. Prize Recipients List: Sponsor will make available a complete list of prize recipients at the end of this Promotion. For a list of prize recipients, send a self-addressed, stamped envelope (ensure sufficient postage is included) to: Prize Promotions, PO Box 390823, Deltona, FL 32729, Attn: Prize Promotions Prize Recipients. Requests for the prize recipients’ names must be received within thirty (30) days of the Promotion’s end date. The name of the prize recipients will also be posted at http://www.prizepromotionsrules.com.
