DirectBuy publishes distinct sets of official rules for each franchise location. These are the rules for the Silicon Valley franchise in California. Although this is believed to be an accurate transcription of the rules (formatting has been changed for readability), the accuracy of the transcription is not guaranteed.
10.2 Official Rules - $50,000 Home Makeover - Silicon Valley
OFFICIAL RULES: NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE ONE’S CHANCES OF WINNING.
Promotion consists of a national program
to award the Grand Prizes (each a "GP"), offered at DirectBuy locations throughout the 48 contiguous U.S and DC., and a local program (where Bonus
Prizes {"BPs"} are made available to be won) offered only at the indicated LOCAL DirectBuy location. National Program is sponsored by DirectBuy, Inc.,
8450 Broadway, Merrillville, IN 46411. Local Program is sponsored by DirectBuy of Silicon Valley, 1157 San Antonio Road, Mountain View, CA 94043.
DATES:
Promotion begins 5/15/10 and ends 12/31/10; but, National Program will end when all Grand Prize winners are finally determined (if earlier than
12/31/10).
If married or engaged and attending the presentation, Sponsor requires that both husband (or fiancé) and wife (or fiancé) attend together a
90-minute presentation about our consumer purchasing service. To play without attending the presentation, mail this original card intact, including key,
with a self-addressed stamped envelope to Local Program Sponsor at above address, to be postmarked by 1/3/11 and received by 1/11/11. Sponsor will
contact you by mail only if you are a potential winner of a GP or BP; if participating via mail, you are not eligible to receive any gifts. Gifts may be substituted at sole discretion of Sponsor if an advertised gift becomes unavailable for any reason.
ELIGIBILITY:
Open only to named addressees of this offer
who are 21 or older, legal residents of the 50 US and DC and have a total annual gross income at or above $35,000. Limit 1 play per household. Current
members of DirectBuy or UCC TotalHome, previous visitors and employees of National Program Sponsor and/or Local Program Sponsor are ineligible.
Members are able to purchase merchandise directly from manufacturers or distributors at their wholesale prices. The prices of the membership and items
available for purchase range from several dollars to several thousand dollars. A driver's license and major credit card or check book are required for identification purposes to attend presentation.

Bring this card with key attached to Local Program Sponsor at above
address by 12/31/10. Attendance at sales presentation required.
GRAND PRIZE:
3 Grand Prizes each of a $50,000 DirectBuy credit to be used towards labor
and materials to create a home makeover through DirectBuy will be awarded. Of the $50,000 GP to be awarded, a maximum value of $20,000 may be
used towards labor. Restrictions apply. Not exchangeable/redeemable for cash unless at Sponsor’s sole discretion.
Make 1 attempt to open the lock. If your
key opens the lock, you are a potential GP Winner. Any Potential Winner of a prize in excess of $600 must sign an affidavit of eligibility/liability and publicity release (where legal) and W-9 form within 7 days of notification, or prize will be forfeited and awarded via Second Chance Drawing (see below). Only
3 GPs will be awarded. A total of 1,500,000 cards will be distributed nationally. Odds of winning GP: 1:500,000.
BONUS PRIZES:
BPs are determined by the
four-digit number beneath the scratch-off area on card and will be awarded at indicated LOCAL DirectBuy location following presentation. BPs: Mitsubishi* 46” LCD HDTV. ARV: $2,199; GE* Side-by-side Refrigerator. ARV: $1,249; American Express* gift card. ARV: $500. Only 1 of each BP is available to be
won at indicated LOCAL DirectBuy location. Total ARV of BPs at indicated LOCAL DirectBuy location: $3,948. Odds of winning a BP: 1:10,000. DO NOT
SCRATCH OFF/TAMPER WITH BONUS PLAY AREA OR REMOVE KEY EXCEPT IN THE PRESENCE OF ONE OF OUR OFFICIALS OR THIS OFFER IS VOID. ORIGINAL
CARD REQUIRED FOR PRIZE CLAIM AND/OR TO RECEIVE GIFTS.
PRIZE/GIFT RESTRICTIONS:
All prize claims/gift awards are subject to verification by
National Program Sponsor (for GPs) or Local Program Sponsor (for BPs/gifts). All unclaimed BPs and gifts revert to Local Program Sponsor and will NOT
be awarded. Cards may only be obtained via authorized, legitimate channels (i.e., directly from Sponsor). Any tampering or reproduction of this card/key,
damaged or illegible cards/keys, or cards/keys that contain errors or irregularities of any kind are void and the holder ineligible. All cards and keys submitted for validation become property of the National Program Sponsor and/or Local Program Sponsor and will not be returned. Keys that may break off
inside the lock or turn the lock by breaking the lock mechanism are deemed not to be the winning key and a randomly selected replacement key may be
issued at National Program Sponsor’s sole discretion (while supplies last). The winning key and the lock it fits must be verified by National Program
Sponsor as the winning key and lock by identifying the special markings known only to the National Program Sponsor’s production agent. No special
apparatus or assistance from an outside source is allowed to be used when the attempt is made.
If for any reason, including, without limitation, a duplication of the prize-winning key/card or other error occurs, and more prizes are claimed in a prize category than the number set forth in these Official Rules,
Sponsor (i.e., National Program Sponsor and/or Local Program Sponsor) reserves the right to award the prize(s) (not previously awarded) in a random
drawing from among eligible entrants claiming the prize(s) in that prize category. In no event will more than the quantities of prizes as indicated in these
Official Rules be awarded.
If all GPs are not awarded, such unawarded GPs will be awarded in a Second Chance Drawing on or about 1/31/11 to be
conducted by National Program Sponsor. Drawing to consist of all redeemed eligible cards (from all participating DirectBuy locations). Odds of winning
a GP in second chance drawing depend on number of eligible cards redeemed at all participating DirectBuy locations and by mail and whether all GPs
were awarded.
GENERAL:
By participating and accepting prize(s), Prize winner agrees to allow use of his/her name and likeness for advertising, trade and
promotional purposes without additional compensation in all media worldwide, except where prohibited by law. National Program Sponsor and Local
Program Sponsor are not responsible for incomplete, lost, late, misdirected, previously scratched, damaged, destroyed, delayed keys/cards, postage due
mail, or irregularities and errors of any kind with keys/cards. No prize substitution or cash equivalent, except as provided herein or at the sole discretion
of Sponsor if an advertised prize becomes unavailable for any reason. This card is NOT transferable. No prize transfer. All expenses not mentioned and all
applicable taxes are the sole responsibility of winners/gift recipients. By participating, persons agree to:
- release National Program Sponsor, Local Program Sponsor, and their affiliates, subsidiaries and agents, and employees, officers, shareholders, representatives, assigns, successors and directors of each from all liability, injuries, loss and/or damage of any kind arising from their participation in the Promotion and the acceptance, possession, use and/or misuse of any prize or gift; and
- be bound by these Official Rules and decisions of the National Program Sponsor and/or Local Program Sponsor, which are final and binding.

To request a list of prize winners, write to National Program Sponsor for receipt by 1/31/11. Be sure to specify Local
Program Sponsor’s name and address on request.
NAME REMOVAL REQUEST:
To request exclusion from future mailings, write to Local Program Sponsor
at address above. Be sure to include your name and address on request. Liability for misprinted data/irregular/erroneous card is limited to the replacement with another randomly selected card (while supplies last). Promotion is void in Puerto Rico and where prohibited by law. Gift offer valid only on
day of initial visit and attendance at presentation.
